Terms of Service

1. Acceptance of terms

By accessing or using ionica.world, the IONICA app, or any related service, you agree to these Terms of Service. If you don't agree, don't use the services.

IONICA is operated by The Ioni Group, with technical services by CRIZZ Global Solutions S.A.S.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use IONICA. By using our services, you represent that you meet these requirements.

3. Account responsibilities

You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity on your account
- Providing accurate information
- Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Bookings and payments

Booking confirmation: A booking is confirmed only after payment is processed and you receive a confirmation email.

Pricing: All prices are in USD unless stated otherwise. Prices include applicable taxes and fees stated at checkout. We don't add hidden fees.

Payment: Processed by Stripe. By making a booking, you authorize the charge.

Cancellation: Subject to the cancellation policy of each suite, displayed before booking confirmation.

Refunds: Processed per cancellation policy within 5–10 business days after approval.

5. House rules

Each suite has specific house rules visible on its detail page. Common rules include:
- No parties or events without prior approval
- No smoking inside the unit (smoking permitted on designated outdoor areas where allowed by building)
- Quiet hours per building policy
- Max occupancy per suite

Violation may result in immediate eviction without refund, additional charges, and account suspension.

6. Guest conduct

You agree to:
- Treat the property with care
- Comply with building rules and local laws
- Be liable for damages caused by you or your guests
- Not use the property for illegal activities

Property damage will be charged to your payment method per the security deposit terms.

7. Property owner relationship

For owners listing properties:
- You retain ownership of your property
- IONICA acts as your management agent per separate Management Agreement
- Commission: 22% for stays under 30 nights, 10% for stays of 30+ nights
- You're responsible for property taxes, insurance, HOA fees, utilities, and any building violations

The full Management Agreement governs the owner-IONICA relationship; these Terms cover only the use of our platform.

8. Intellectual property

All content on IONICA (text, images, logos, design) is owned by IONICA, The Ioni Group, or licensed to us. You may not copy, distribute, or use our content without permission.

Photos of suites are taken by IONICA or owners and used with permission.

9. Disclaimers

IONICA services are provided "as is" without warranties of any kind. We strive for accuracy but don't guarantee that:
- The platform is error-free or uninterrupted
- All listings reflect current availability
- Photos perfectly represent the property

We're not liable for indirect, incidental, or consequential damages.

10. Limitation of liability

To the maximum extent permitted by law, IONICA's total liability for any claim related to our services is limited to the amount you paid for the booking in question.

11. Dispute resolution

Any dispute will first be addressed through good-faith negotiation. If unresolved, disputes will be subject to mandatory arbitration in Miami-Dade County, Florida, under American Arbitration Association rules. You waive the right to trial by jury and to participate in class actions.

12. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles.

13. Changes to these terms

We may update these Terms. Material changes notified by email at least 30 days before effective date. Continued use after changes means acceptance.
